These Terms and Conditions ("Terms") govern your use of Claim IT, a mobile and web application (the "App"), provided by Claim IT Inc. ("Claim IT," "we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. Please read these Terms carefully before using the App.

Terms and Conditions of Use

1. Account Creation and Usage:
   1. 1. You must create an account to access and use the App. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
   2. 2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify Claim IT of any unauthorized use of your account or any other breach of security.
   3. 3. Claim IT reserves the right to suspend or terminate your account at any time, with or without cause, and without notice to you.
2. Company Management:
   1. 1. The App provides tools for company management, including tenant-based solutions, allowing each company to have its own database that is encrypted at rest.
3. User Management:
   1. 1. The App enables the management of users within your company, including employees and contractors.
4. Projects Management:
   1. 1. You can manage projects within the App, including tracking project progress, assigning tasks, and generating reports.
5. Timesheet & Leave Requests:
   1. 1. The App facilitates the submission and management of timesheets and leave requests for employees and contractors.
6. Reports:
   1. 1. The App generates various reports, including user, project, client, company profitability, and general status reports. It also offers AI-based reports such as utilization, cash flow, profitability, revenue forecasts, and profitability forecasts.
7. Invoicing and Expense Management:
   1. 1. The App allows for client and contractor invoicing, as well as the submission, approval, and management of expense requests and reports.
8. Integration:
   1. 1. The App integrates with Microsoft and Google sign-in for user authentication and offers default two-step verification for all user types.
9. Beta Phase and Payment:
   1. 1. Claim IT reserves the right to offer the App for free during beta phase testing. After the beta phase, Claim IT may enable payment methods for continued use of the App. By using the App, you acknowledge and agree to this condition.
10. Disclaimer:
    1. 1. THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CLAIM IT MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE APP OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED IN THE APP. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CLAIM IT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
11. Limitation of Liability:
    1. 1. IN NO EVENT SHALL CLAIM IT OR ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF CLAIM IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Governing Law:
    1. 1. These Terms shall be governed by and construed in accordance with the laws of Romania without regard to its conflict of law principles.
13. Changes to Terms:
    1. 1. Claim IT reserves the right to modify or replace these Terms at any time. If a revision is material, Claim IT will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Claim IT's sole discretion.

14. Acceptance of Terms:
    1. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the App.
15. Functionality:
    1. Claim IT is an operational tool designed for Digital Agencies, providing various functionalities including but not limited to Company Management (tenant based), Users Management, Employee Management, Contractor Management, Projects Management, Timesheet & Leave Requests, Reports, AI-based Reports, Timesheets Approval, Clients Invoicing, Contractor Invoicing, Expense Requests, Expense Approval, Expense Reports, and integration with eFactura.
16. Multi-Tenant Solution:
    1. Claim IT provides a multi-tenant solution, ensuring that each company has its own database that is encrypted at rest.
17. Security Measures:
    1. Claim IT offers two-step verification by default for all user types and integrates with Microsoft and Google sign-in for enhanced security.
18. Modifications:
    1. Claim IT reserves the right to modify or revise these Terms at any time. You agree to be bound by such modifications or revisions and should therefore visit this page periodically to review the most current Terms.

By using the App, you agree to abide by these Terms. Failure to comply with these Terms may result in the termination of your access to the App.
